Dear Tejaswi,
Do you mean to ask that whether son can avoid court proceedings and fly away overseas.
If son fails to appear and answer the charge, an exparte order will be passed against son.

If the trip is for a short while, the advocate can make applications seeking to condone absence of the party and he can prosecute/defend the case on behalf of the party during his absence.

if the son is reday to pay the maintinance then no need to filed any application before the court but if the son want to fight the case then filed an application for exemption.
but i think is father is petitioner due to his duty the son should pay the maintinance to him.

what if the son had already payed an amount of Rs 3,30,000 for the studies spent by the father on his son ?
Legally it is the duty of the father to provide education, but what if that father has taken back that money ...... how could the money paid by the son be adjusted or reclaimed ???
