Sir I have completed 4 years and 9 months in my current organization. First 6 month is probation period. But the deduct PF ESI and Professional Tax also. After my resignation they are denied gratuity for first 6 month is probation so you are not qualify. Could you please advice me?

Your employer answer is correct. individuals are not eligible for gratuity after completing 4.9 years. However, as per a ruling made by the Madras High Court, individuals who have completed 240 days in their fifth year of service are eligible for gratuity.
