GO thru;

Payment of Gratuity Act,1972:Sec:2A {( 2)(a) (i) (ii)}

https://www.labour.nic.in/sites/default/files/ThePaymentofGratuityAct1972.pdf

If the establishment works for 6days per week/ less than 6days per week and emplyee has worked for 240/190 days in a year and last year then employee should be eligible.

Payment of Gratuity Act,1972 does not dicriminate between 'Workman', 'Non Workman' and NO wage celing  applies...

You do not seem to have worked for 240/190days in 5th year, hence until or unless employer has provided you with better terms of Gratuity (in writing on record) you may not be elgible.

Go thru; Payment of Gratuity Act,1972; Sec 4(5)

Employer can pay by its sweet will...........
