Gratuity rejected by employeer

Model Standing Orders:


16.  Certificate on termination of service.--Every permanent  workman shall be entitled to a service certificate at the time of his dismissal, discharge or retirement from service.

 

 

NOTE. - There is a provision under  this  Act for issuing a service certificate at the time of  dismissal, discharge or retirement and every person is entitled to take such certificate.

 


 

>> Does the company issues pay/wage slip every month, and provide for PF, ESIC, Group Insurance, Gratuity, Bonus etc...........................

All of these are proof of employment.

Salary slip has to be issued by employer before payment of salary and should be signed by both employer and employee.

Payment of wages Act: Sec 13A

 

Employer has to maintain record of wages paid for 3 years as per this Act.

Employer has of maintain proper record of various forms and registers under Shops and Commercial establishments Act too.

Dear Sir;

Thank you for your advice.

Of course legal discourse is available. But, considering to our system, it is not easy and employer will not wait until then.

Already for gratuity case I have spent substantial amount, yet, case is not concluded till date.

However, I will continue with my battle.  I know truth and someone has to show courage to fight against such elements.
