Gratuity underpaid

Dear Sir I was employed at a senior level in a Public listed company for 16 years and as per terms of gratuity, I was to get 8 months salary last held, however, the management sighted that only 10 lacs is allowed as per IT rules and hence they underpaid the dues on this pretext. Their argument was that amount over 10 lacs is prerogative of the management to be considered as super annuuation. Pls help and guide if I can file a case for recovery of the balance amount. You must erase the names, logo etc to maintain confidentiality.
