Husband falsely accused of 498a.Wife lodges complaint case in her residing district/state. Place of marriage & last residing place with husband was in a different distt/state. Wife very influential in her district and wants to pressurise/threaten husband to obey her demands.Husband prays for quashing ( CrPC) in HC. However in HC the cases are usually referred back to trial court.
Husband wants to move TP in SC on two grounds-a) danger to life b) lack of jurisdiction. Though the chances are brim but if contested on merits, then SC may likely transfer to neutral place subject to husband paying for wife travel. The outcome of the case depends upon the competence of lawyer, who has dealt with such cases earlier.
