Guidence under rti, act2005

Respected all experts  dt 21-06-2014

Good evening for all. 

The documents requested from the CPIO under RTI,act,2005,  [by my mother aged 74 years[]are

1) Attested copies of, inward register pages  and

2) Station diary pages for certain period.

The CPIO not provided information documents, under section 8(1)(j) of RTI,ACT,2005.

 Appeal filed with  1st appellate authority.

1st Appellate Authority asks to appear for personal hearing. Every time Personal hearing letter received after hearing. The same was informed them and of requested to send all correspondence by speed post (speed post chargers provide by IPO).

1st Appellate Authority also informed regarding not able to attend the hearing due to undergoing chemo therapy treatment (for support of the claim attached copy of CGHS doctors; certificate) and  requested to pass the order on the basis of submission made by us.(i.e. direct the CPIO to provide the requested documents, sine no document have been provided by the CPIO).

1) Please guide us it is mandatory to attend personal hearing as asks by the 1st Appellate Authority?

2) Can the 1st Appellate authority denied the information documents due non attend personal hearing. ?

if yes , can it is possible to mentioned section/provision of RTI Act,2005 for the  above 1) & 2) points.

If no information is provided it has nothing to do with you. The appellate authority should ask the PIO why the information is not provided. There is no provision under rti act that appellant should be personally present for hearing. In your case when no information is given the PIO should be personally present not the appellant.
