I need your help in forming the case.
Our company based in Gurgaon approached an IT company based in Nashik to develop a website for us (found the Nashik company on freelance.com). No written agreement between us (I know we should have but ...). Now we transfered around Rs. 20,000 from our company account to their company account. Initially they showed us that work is going on but one day they stopped responding. No anwser to email or phone calls.
Our website is already complete and we do not require their service any more. We want our money back.
Please correct me if I am wrong or missing something:
1. I have to file case in Nashik District forum
2. I have submit one original and 2 copies of matter
3. Matter should be on plain paper and not on company leterhead
4. Rs. 100 demand draft has to be submitted in the name of President, Nashik District Forum
5. Do I need any affidavit as we do not have agreement? If so, what to write in affidavit?
6. Attach all email conversations we had.
Please help me as Lawyer wants from Rs 200000 as fee to help me file the case.
