Helpp help help urgent

My sister in law filled a caw complaint last year but dint file any cases n later my brother and my bhabi decided to live together but my brother asked her to write in her caw cell that she filled a wrong complaint n she did and they signed a mou to start living again together. but later my brother asked asked her to file mcd to saveguard his family n they both mutually filled it but continued to live together but somhow somthing went wrong n my brother left the house(rented) and asked her to continue with divorce they lived together for around 4 months in between of mcd and once they started living separately he gave her first motion cheque but they had a arguement and out of ego clash my brother did a stop payement. my brother still have her jewellary with him and she asked for her jewellary and my brother alwasy replied that give his and take her jewellary. . but now the situation is that in between my brotheer did a stupidity and asked her to come back again or take divorce for free. she came to my house and created a issue he called police but he wrote in front of police that he is ready to keep her but she kept on fighting and asked me to give her cheque and jewellary n complete second motion n very next day but somehow nothing happened and after some days he asked her to settle the divorce in lesser amount she dint agree and now she is not ready to give him divorce. she is threatening him that she will now get the mcd cancel and file rcr or file dv case she want to live in our house. now my brother wants to move out of city and ready to pay the amount but she is stuck now she is saying that my brother done a enough mental cruelty on her now she will fight and will get the share residence. please help us i know my brother did lot of blunders but what can we do now. they even filled a back dated seperation divorce and now she is saying she is ready to go to jail but will tell court how my brother and his lawyer played a game n trapped her to give divorce. whn she wanted to live.

now she want to cancel mcd and file dv case for residence and rcr. my brother wants divorce. she is asking for both side of jewellary now but my brother is saying take only one side of jewellary or fight in court. but he has sent her many sms in which he agrred to the fact that her jewellary is still with him. please help us n suggest some good lawyer and can she get a share household or a stay on our property or can she drag us or can she demand both side of jewellary please help us. what if my brother file contested divorce she is giving him challange that she will get it cancel she will not take even a single blame on her and she will file rcr the vary same day . she demand mantaince.? can she get share household just on rcr or in dv?

After such asking her to come back is not only foolishness, but equal to comitting suicide.

Now ball is in her court. She will play with your brother as if he is a ping pong ball. If you do not want to face such cases etc, then already two times reconciliation has happnd, so why not reconcile one more time? Tell her, you ppl agree to all her terms and conditions and she will be treated as queen etc and bring her back. Or fight cases based on merits.

Ok, nothing to worry. Check if wife has bills of such jewellery etc. if she does not have such bills, go ahead and sell such jewellery and make money.

If brother file divorce and she contests it, then, 5-6 years gone.

she is giving him challange that she will get it cancel

She cannot get it cancel.

she will not take even a single blame on her and she will file rcr the vary same day .

Let her file RCR. Nothing will happen.

Yes. She can claim maintenance,. but if she is a working woman, she cannot get maintenance.

can she get share household just on rcr or in dv?

In DV she can get right to residence. But she cannot ask for property in rcr or dv.

i dont knwo she has bills or not but she always say she have all the bills and photographs of your side of jewellary and my brother sms in which he wrote give me my jewellary and take yours? so can she demand both side of jewellary?

sir i have heard in many cases divorce is denied to man and wha if divorce is going on and she file rcr will it effect divorce case? my brother is looking for girls to get married through matrimonial sites what if my brother file contested can she oppose that matrimonial account?

so it means in dv she can get access to our house? no she is not working and my brother always maintained that his wife will never work after marriage can she get maintaince on that point that she dont want to work and to enjoy same lifestlye because his husband never allowed her to work so why is he asking her to work now?

but my main ques will my brother will get divorce 100% after 4-5 years os is thr a chance of divorce petition dismiss

she has a sms proof and she is saying she will proof that her jewellary is with us sir will she get both side of jewellary and residence right? even though divorce is going on she can get access to our house?

The way you have asked the query seems the cooked story.....

Plz come with factual story,as per your first post,then second post,then third post reflects that your mind is not stable,it seems that this query is your's rather than your brother,so,plz don't be a third person.As from first post your query reflects that you/your brother done a blunder by calling her,in second post it shows that you/your brother intensionaly doing blunder as you openly written that for remarriage your brother is searching bride on matrimonial sites and in third post you have stated desperately that within such years 100% i will get divorce/he will get divorce.

So,it's highly recommended that never lie to a doctor or an Advocate bcz one is life saver and other is life getter.

Now come to the conclusion:

1. I agree with the reply of Helping Hand.

2. Divorce is such phenomena where money is equivalent to your freedom,so don't think about money if you desperately need freedom to remarry.

3. No RCR or DV could make her to forcefuly live with you/your brother.

4. Hire a good Family lawyer localy and have a discussion with him covering all points and exactly what you want.
