Counsel of the accused has only to see at the stage of framing of charges that the charges are not framed under wrong sections.

Before framing charge if the adocate feels that there is no  grounds to substatiate the case and the charge is groundless then he can file a petition U/s 239 and argue the case. If it is worthy  the case will discharges. if not it will proceed. This oppurtunity is only when the charge is a groundless one.
