Dear Sir,

Now at this moment i need to file the counter for the interim maintainence claim asked from my wife and daughter for Rs 25k. ( Rs 10 k for wife +Rs 15 k for my child).

I dont want to pay a single penny for my wife and child as my wife is working.

I am ready to take the custody of my daughter if the court permits but no maintainence.

Please suggest me how to file the counter by giving a valid reason in order to protect me from the interim maintainence charges. My Wife is not at all interested to live with me and also not willing to allow me meet my daughter. i need to file the counter before 19th of April 2018 so am waiting for your valuable suggestion.

Dear Sir, My wife said she want to divorce me and told me she will not come live with me and charged me am a bipolar patient and took my daughter with her when she left my home on last 31st July 2018. The main issue between her is 2 things . One is that she dont want to live along with my parents and number 2 is she dont want to do the financial planning with me as she is very much insecured to reveal her monthly income. Once she left my home she completely stopped communicating with me to any of my calls or emails etc. when visited her office she said they are looking for the lawyer for the divorce procedures and instructed me to leave as her lawyer will contact me within a short period. when asked her whether i shall see my daughter she initially said ok but when entered her home my daughter was taken somewhere by my mother in law and not given the oppurtunity to see her . only my father in law was available inside the home and he was keep saying that he will call the police if i dont get out. when insisted I want to see my daughter he added that its a girl baby and without the permission of my wife i will not be allowed. I then waited for my wife to arrive her home from office. But over phone she was contacted and given the same phone to me to instruct her that i should leave immediately. when she also said me that i should leave and take it up legally. Out of no options i consulted a lawyer who said that the constitution is favoring women in all situation and asked me whether you want divorce or reunion . I said that since from my wife side is very adamant on the divorce, i also go for the divorce. Lawyer said he then file the divorce petition against my wife and when she is also interested then we will close the issue once for all. on reciept of the petition , they filed the counter stating that they will give the counter allegation afterwards and in the same time they are demanding for the maintenance of Rs 25k for my wife and child as she is without job at that juncture. Having checked with her colleges it was informed that she is working in a company. Now i need to file the counter and my intention is very clear i dont want to pay a single penny for my wife and child as she is working. Please suggest me a strategical move on how i should take it forward in order to take my child into my custody and get divorce from her without any commercial implications. please suggest......In case of mutual consent divorce they were demanding Rs 10 lacs amount from me which is totally unfair. So I humbly request Lawyers club of India to suggest me on what to quote in my counter petition for not paying the interim maintainenance....
