how to convert section 306 in 302 in FIR

hi,

My sister died in the house of her in-laws we feels that it was a murder but police advised us to get FIR registered in CrPc section 306 (abetment to sucide) not in 302. As per postmortem report the reason for death is Asphyxia due to antemorterm hanging but when we had checked the dead body there was the injury marks on her whole back. also her in-laws didn't informed the police if she had committed the suicide. We informed the police when we reached at her in-laws house and found suspicious death. Our FIR is registered in section 306,323 and 504. The charge sheet has not filed by the police.

please suggest what should we do? This matter belongs to UP.

It is very difficult to fight against the police alone.  You have to seek guidance from a local Women's organization and through them make a petition for registering the complaint with proper sections basing on such facts and investigation.  There are many such Voluntary organizations and some are even affiliated to ruling and opposition parties.

If the police do not include Section 302 IPC in the charge sheet submit an application to the Trial Court.

Thank you sir, Can we do something before filing of charge sheet by the police? like application to SSP or in the court.
