Under section 13 of the Hindu Marriage Act, desertion by spouse is a valid ground for divorce. The relevant portion reads thus: the other party- (ib) has deserted the petitioner for a continuous period of not less than two years immediately preceding the presentation of the petition; So you can approach the Court and ask for a divorce on these grounds. However, you need to also know that in such cases women usually file a lot of false cases against husbands and try to get as much money from them in the form of alimony and maintenance.
