How to get divorce

Respected sir,

iam ganesh from hyderabad. my wife had gone to her parents house in sep-2011.till now she had not returned.i had mailed so many times and send two registered post but she returned them.i had filed GID in police station , police s.i asked her but she said to him that her parents had done her marraige forcely. but they are not giving divorce, ihad gone three times to her house but they scolded me thrown me out. so what to do , can i apply divorce directly in court as our separation done nearly 2 years 2 months. plz suggest me what to do?

yes, if you don't want to live with her and she is also not interested to cohabitat with you as she stated that she was forcibly pushed to do this marriage , you can file the divorce on the ground of desertion u/s 13,13(i-b) HMA.

thanku sir but how can i prove in court that she that to police official as it is only gid not fir.

Hello Ganesh,

Under section 13 of the Hindu Marriage Act, desertion by spouse is a valid ground for divorce. The relevant portion reads thus: the other party- (ib) has deserted the petitioner for a continuous period of not less than two years immediately preceding the presentation of the petition; So you can approach the Court and ask for a divorce on these grounds. However, you need to also know that in such cases women usually file a lot of false cases against husbands and try to get as much money from them in the form of alimony and maintenance.
