I am Kiran ,My Marriage was done in Oct 2010 , after marriage she wants to continnue her studies, so i agreed to stay with her parents in her home town , she has came to live with me on july 2011 , we stayed together upto nov 2011 , with in 3 months hardly she stayed with me 40 to 50 days . she always talking on Phone and phone was locked with Secret code .
She always fight with me to goto her home town for every 10 to 15 days . Later i enquired her Phone calls Privatley , now i concluded , my wife had Boy Friend in her Home Town , they are talking on Phone Every day atleast 40 Mins to 3 hours every day with MIDNIGHT Calls . my family discussed this matter with her family at that time she agreed about calls and she said that she dont like me . from last december i am asking for Mutual Divorce ,but they are demanding 10 Lacks from me to agree for Mutual Divorce. if i didn't agree to pay 10 L they are willing to File 498A Case :( .
- Can i File IPC 497 with Phone Call Records ? and My Wife used sim is registerd with My Name and BoyFriend's Sim Registered with his name.
- IPC 497 what type of evidences required ?
- Can i file case under "Cruelty " related sections ?
- What type of steps i can take in this momment ?
