How to get hospital treatment records through court order ?

In a Motor Accident Case, party require Wound Certificate & Treatment Records from Hospital.
Party wrote a letter to Hospital in this regard, and the Hospital replied that Wound Certificate
& Treatment Records could be given only on direction of Court, as this is medico legal case.

What type of Petition should be filed to obtain a direction from Court to Hospital, to deliver
Wound Certificate & Treatment Records ( including name & address of doctors who conducted
treatment ) to the Party ?

Kindly advice.....

Hospital authorities have no power to deny you this certificate. Meet the higher ups and if they still do not provide it, file a case against them in a Consumer Court for deficiency in service

If you know the date and time of treatment given to the injured by the hospital then visit to their record room write an application (make two copies )regarding to obtain medical treatment certifate to the victim/patient, the record incharge will charge the certificate fee and issue you the certificate, immediately or next day, don't forget to take receiving of your application, if he denys to issue you then move to consumer court along this copy with your petition and file the case against the hospital , you can also get the copy by giving them direction through court for that you have to move an application in the concern court where your case is running make a request to the judge to give direction to that hospital (give complete name and address of that hospital )to bring the medical treatment record of yours before the court on such and such date .

The details of injuries sustained by a person is submitted on formal written request by the police and detailed injury report is called medicolegal certificate. As the doctor who is issues this  certificate has to attend as expert wittness in courts when such cases are put up for trial  he is compensated for him time away from work by court for the same.
