How to settle the amount for mutual divorce?

Both parties (boy and girl) have now agreed to settle the case through mutual divorce. Boy has to give 8 lacs to girl so how should this payment be given considering 6 months cooling period? Boy fears that if he gives all or 50% of money up front then girl may not turn up after 6 months and he can loose money. How should this payment thing be settled considering girl may not appear after 6 months to sign the divorce? Should all the money be given after 6 months, if yes, then how to convince girl and his family for this?

There are no legal fool proof way as asked to give advise upon is my opennign view.


BUT;

 


There are two time tested social ways out when we come to cross the bridge;

One – Find a neutral person whom girl side also gives weighting and place this moneyrama issue before him and now HE has to guess who among the boy and girl wants to wriggle out of this marriage faster desperately! His then opinion should be valued by both parties remember that without much questionings.


Two – Meanwhile calculate market rate of interest on 8 L for 6 months and feed that neutral person to pass on the message from his (and not from your side) side that both parties will execute jointly an MoU and at the time of first motion recording of statement of parties the boy’s side will give the interest amount by way of DD in girl's name under record of the Court along with D/D in the name of girl for 8 L which will be deposited in court records to be released only after recording of second motion statement of parties and at the time of passing of Decree in Divorce proceedings as his (neutral person’s) side of gesture for girl’s side protection !


You need to note here that the message should be passed from a neutral person to the girl whom girl and her side trusts and least to least what will be your so called loss at the end of this social exercise – loss of only the compounded interest on 8 L compared to 50% odd though process you put before us for advice that is all !


We executed (tested) such advice before giving to you in few past MCD cases and it worked well for a simple reason the neutral person works as tie-breaker at such last mile no-trust vibes in air and he also acts as much needed messiah in times of no-trust situation between the parties more so for the girl as she is the main queen bee here whose final approval would break the marriage bond of parties finally and not yours. So last mile humbleness with little extra paid never goes waste is time tested view.


However after her side’s approval on above second para offer, continue keeping faith on Lord Hanuman for next 6 months and suggested to go for it with crystal clear mind during the offer period and proudly spread positive vibes about parties joint execution of said MoU with above social terms and conditions for a happy unilateral tomorrow of parties
