Illegal possession of huf property

Sir,

The HUF property in our village is illegally occupied by for the past 15 + years, and we asked the person in possession of the property he is saying that he has purchased the property, but the EC applied for past 35 years does not reflect any transaction. Since we have moved to city we don't have any support in the village and plan to take legal steps only. Still the EB connection of the above property is in the name of HUF head and the person staying in the property has taken patta in Joint name of one of our family member and his name which we are contesting with the local panchayat office.

Need advice and expert opinion on what legal steps can be taken to get the posession of this property which is our ancestrol house. Also if the house is climed by the other person can we claim the vacant lant behind the house.

Sir, to answer you question late Pravamasivam was the HUF, he had 4 sons all are not alive. The current HUF is headed by son of the eldest of the 4 sons of Paramasivam and compraises the kin and kith of 3 sons of paramasivam. The where abouts of the 4th son family is not known, but it is in his name the joint patta was issued in 1987. The other person included in the patta does not have any connection with our family.

We have contested the genuineness of the patta and the appellete authority has given a descision in our favour and following with thaluk office to get the name transfered.
