Can a regional office of any central agency claim immunity under Article 370 of Indian Constitution?
I had filed an online RTI application with Ministry of culture seeking information regarding the changing of name of world renowned Shankarcharya Hill in Srinagar Kashmir by the department of Archaeology. My application was transferred first to Arcaeological survey office at Janpath and later to Its Srinagar Circle office.
Srinagar Circle, of Archaeological Survey of India in its reply informed me that RTI Act 2005 does not apply to J&K, hence no information was provided. [copy of the reply is attached]
Are they constitutionally and legally right?
