Impleading as petitioner

I am facing a strange issue - my lawyer ditched me at the last minute and I am thinking of action against him but in the meantime the case is coming up and he was supposed to move an application in a partition suit asking me to be made a petitioner. I am currently a defendant but the petitioner has not taken any interest in the case and now it is getting held up. I want to be impleaded as petitioner since all parties in a partition suit are entitled to seek to be treated as petitioners. How do I make this application, under what section and how much stamp do I put on the application in the saket courts in Delhi ?

If u state the full fact of case then u get solution for it.

U can file case in district bac counsel against advocate for any wrong.

The correct remedy depends on the outcome of the case as a result of the default of the plaintiff. If the case is still pending, then move an application under order 1 rule 10(2) of the CPC. If the case has already been dismissed then move under order 23 rule 1(a).
