IMPLEMENTAION OF LAB LAWS.

Dear Learned members, Please advise the following queries :

 

1)        We are constructing a Power Project near Chennai, India. As a responsible Corporate citizen, we have to implement various Labour Laws. As we are in the construction stage, whether Factories Act 1948, is applicable to our Project OR Building and other Construction Workers  Act, 1996 is applicable?

2)     We are a Joint Venture organisation i.e., it is a Project formed under Joint Venture Agreemetn betweena Central Public Sector Undertaking and a State Public Sector Undertaking.  Who will be the appropriate government, whether Central Government  OR  State Government?

The Contract Labour (Regulation & Abolition) Act would be application. For the appropriate government whether state or central,  you need to check the notifications issues under the CLRA Act.
