Today I would like to bring an issue which i didn't got any clarity from the sources i have arround with me.The issue is as under:
One of my friends found some property (independent house) in hyderabad, A.P. under the GHMC circle would like to purchase the same. He has enterent in to an agreement with the seller and wanted to go for home loan with some private bank.
The bank legal advisor wanted all the link documents for last 15 years where as my friend is having only for 7 years link documents as original document was executed only in the year of 2005. later the siad legal advisor asked to provide pahanies for the remaining years and same was arranged by my friend and was informed saying that the said property is belongs to inam land hence we wont give loan unles you provide occupation right certificate from revenue department for the same.
I have gone through all the documents what he is having with him. and i am having the quirries below. I would be thankful to the persons who give the clarity on this.
I found that in pahanies it is mentioned as mafi inam. in pattadar passbook it is mentioned that the legal heir has sold the property to some x and was registered as AGPA.
If it is inam land can it be registered as AGPA and mentioned the same in pattabook?
If it is inam land can the registrar make it registered further from the AGPA holder to some Y?
If it is inam land how can the government has given permission to leguralise the said land under LRS scheme. it has been regularised as per the government notification. even after LRS also can this land may treated as inam land?
If it is inam land how can the GHMC has given permission to construct house in the said land. even after construction also can it may be treated as inam land?
Finally it can be treated as inam land or regularised land? My friend would like to go for registration with his own money. but is there any further process or documentation required.
Please let me have some solution/ clarification on this.
