Information needed

 

Hello, 

I had taken a Personal Loan (Loan Account #LC013111870530) from Barclays Finance (Bangalore) in June'2008. The loan amount taken was Rs. 1,50,000/- .Though I admit (my fault) that I had defaulted on my payments but I've paid Rs. 74,928 till March'10. Then I lost my phone & alongwith it, lost my job & the contact numbers of the Collection Agency, Plutus Associates, 55/2 1st & 2nd Floor, 13th, "H' Main, Vasanthappa Garden, Doopanahalli, Hal 2nd Stage, Bangalore - 560008. So after many months, I get a call from this collection agent Manu (Phone# 9663328369) who told me that I've an O/S amount of Rs.1,94,592/- (including the interest) & that the loan is in OD of 655 days. I did not have a job so I asked them if it is possible to settle the amount, in instalments. He asked his Supervisor, Mr. Vijayshankar (Phone# 9980055770) who informed me that I can settle it for Rs.80,000/-. in 3 months time. I agreed & asked them to email the Settlement letter to me so I could read & sign it. The Manager, Mr. Vijayshankar informed me that the first instalment has to be via cash of Rs. 30,000/- & for the other two instalments, he needs post dated cheques. 

I agreed to it but told him that I will give him the numbers on the cheque only after he sends me the scanned copy of the receipt for the cash payment (online transfer) that I made on 30/06/11 to an Icici Bank account. Till not even after repeated messages & calls, they still haven't emailed the scanned copy of the receipt & still insist on getting the cheque numbers. I also got a call from some lady who refused to give me her employee id, saying that she is calling from Barclays Finance Legal Board based out of Hyderabad. (Phone# 040 44545465). I just have a question, If the loan amount is Rs. 1,50,000/- & if I've paid till Rs. 74,928 till March'10, then why is the O/S amount Rs.1,94,592/? Don't I have to pay only Rs. 59,928/-? So is the interest amount Rs. 1,19,664? Calls to Barclays finance Customer service is also useless since they told me that they cannot access my loan information as its been called for a settlement.

Am I being taken for a ride here? Could someone help me how to go about it cause I don't want to be cheated anymore. Please help me!!!

Apparently you have neither received any settlement letter, nor the receipt of online payment of Rs.30000/-.

In all probabilities Rs.30000/ have been adjusted in total amount o/s towards you and interest penalties are still being added on daily basis.

Moreover all transactions are on phone. Have you recorded any of the calls during which company has stated to settle the a/c in three installments.

Kindly conduct all transactions by letter only .Submit  all payments by cheque only and along with a covering letter, in which you should write the purpose and intent of the cheque and reference of all transactions after which cheque is being submitted, and deposit letter and cheque in person at local branch and obtain acknowledgment under seal and signature on the copy of letter and photocopy of the cheque. Write the purpose of the cheque on the reverse of the cheque.

You may not able to settle the matter in a very sincere, innocent manner.

Kindly obtain legal advice from your local lawyer. You may be able to settle the matter at even lower amount.

As per RBIO guidelines bank has to supply you in writing the complete name of firm and contact details with address of their recovery agency. You may accept calls from the number mentioned in the letter only.

Recovery agents can not come to your address without the copy of notice of the bank and their original ID.

One of imp. condition of the settlement is that company shall not demand any amount over and above expressed in settlement letter and shall issue NOC and clean the record with credit rating agencies e.g. CIBIL, SATYAM, etc.
