IPC Section 176. Omission to give notice or information to public servant by person legally bound to give it.
What determines as to whether a person is legally bound to give such information or not?
Does the section apply to a situation where a public servant can give such information(sensitive information for that matter) to another public servant? or is there another law for this scenario?
Is there any law as to who is bound to give information and who is not bound to do so?
Which law defines such binding or non-binding?
If the same information is known to two persons and one being a public servant and the other a non- public servant and if any one of them gives such information to another relevant public servant a mishap or unintended event could be avoided, is it not required of both to give such information to such relevant official, especially in view of the fact that the possible omission by the non-public servant could benefit him whereas the omission by the public servant could impede the plan of the government and possibly lead to loss of time and money and cost the exchequer by way of litigation?
