Is it possible to file fir under dp3?

Respected All Member,

A FIR  was loddged by my WIFE(Ist Party) under section 498A, 406,506, 34 of IPC.  After a long trial the court acquited all our family member i.e myself, mother, sister and my father.

In the FIR the carged was farmed against us demanding of dowery & in the court from the side of my wifer it is clear cut mentioned that her parents gives dowery beyond there capacity.

Now against the decision of the Ist class magistrate the Ist party file the appeal in the session court.  In the matter of the appeal the ist party again mentioned that her parents gives a lots of dowery beyond there capacity.

Now my query is :-

1. Could I filed the DP3 against them.

2. Her father had already expired than against which I could file the DP3.

3. what happen in the appeal in the session court and what precaution I have to take?

4. The appeal filed by here is time barred by 12 days as per her advocate and the base given by her is that she requested the PP to file the appeal but he has not filed the file therefore I have to file the appeal at my end.

Please give your precious guidance.

DP3 can be filed, as few FIRs have been registered under this section.

 

However, overall the success has been limited in this.
