land dispute of malik gairmazarua

there is a land in front of my land near NH - 82. some one has been using this part of land since a long years. however land record reveals that the land is MALIK GIRMAZARUA in bihar survey. the person stating that his ancestors taken this part of land from jamindar on account of HUKUMNAMA. what legal action should be done against the person or otherwise? pls also clear the legal properitor of land.

First, get the certified copies of records that show the land's possession from revenue records.  Contact a local advocate and issue a legal notice to the authority that is lawful owner and report about the occupation by Sri...........................and request them to evict the person from Public property.

Inform the Collector of the facts and let the Govt record and issue notices for eviction, if the name of the Zamindar is not stated in revenue records.

The former Jamindar was competent to  make such settlement,s of .MALIK GIRMAZARUA. Whether such grant had been made and if at all made, whether it had been made validly, are questions of facts which needs to be ascertained from the relevant public records.

then why Bihar government ban for collection of revenue of all malik gairmazarua land in Bihar state since 2017. there is a lot of land in my village of malik gairmazarua which were evicted automatically by land owner because no paper available with them. one court order also declared 10 yrs before and land dexlared as public land.

You may obtain the details of the land through RTI act and then you can make a written complaint to the land revenue department about this encroachment against the illegal squatters.

Since this is not your property  and you believe that this government land has been encroached by some unauthorised persons, as a dutiful citizen you may either report this matter to the District revenue officer or can file a PIL before high court if the DRO is not taking suitable action as per law to evict the illegal squatters
