Land registration

Hi Sir,

Four brothers, one Property i.e.. Land is to be sold., Three is like minded, but another one is opposite. he demanded more . So is it possible to make registration without his consent ?

1. IF Property is undivided (non partitioned), THEN such property can be sold only with mutual consent joint signatures of all the owner parties.

2. IF one of the joint owners are not amicable, THEN Partition Suit has to be filed in local Civil Court for division of property consequent to which each partition can be sold individually.

Yes. File partition suit in the court and after getting orders from the court concerned, do as ordered by the court.

Get the property partitioned before making it marketable, otherwise, all 4 have undivided and share which is yet to be demarcated, for which any vendee shall insist.

In my understanding, undivided share could be sold. But such sale may fetch only lesser return.

Apparently the property is a joint property and if so, unless all agree to sell it cannot be sold.
