Land with buildling - partition

hello, how is a partition recommended by advocte commisssion for a land with building .we have a building to the extnt of 1.5 ground on a 2 ground land in orissa. wll the advoate commissioer taken into the account the building n the land when demarking the land share.

or will the advocate commissioner asks for complete delomition of the land.this is n a hindu family partition.

once a share is confirmed, am i allowed to demolish the section of buildling that intrudes into my share.please confirm

Do not speculate.  Wait for the Commissioner's report.  Have patience.

ok.just want to know the options that we usually get in this case of land  with buldling.
do they usally take into considration the fact to avoid any demolition of the building or the cost spent to construct  t

The "Local" Commissioner and not "Advocate" commissioner appointed by the Court shall submit his/her report on the terms and conditions of his/her appointment.

Consult your lawyer for better appreciation of  facts and directions of the Court.

Commisioner's recomendations need not be allowed by the court if there are valid objections raised by any of the party as these are baised againt them and new local commissioner can be appointed for fresh inspection and recomendation to the court.
