Leave license agreement

I have my flat in Maharastra at Virar.I had given my flat on rent after signing leave license agreement. As per agreement tenant could stay upto 22 months but he stayed there for 26 months (4 months extra) . Now society asking me to pay penalty as my renter stayed four months extra without agreement .Please advice me.Shall i have to pay penalty ?

No need to pay any penalty but if there is a non occupancy charges then yes you have to pay only that.

Please refer to New Model Bye Laws. Every Society needs to function as per these bye laws if any society wants to initiate any penalty the bye law shall permit it.
