Leave queries

Sir,

 

I am working in a textile company (LIMITED COMPANY) at Surat, Gujarat.

 

The Company does not allow any leave except 3 days in Diwali.

 

For all the other festivals/holidays company mandatorily make us present at sunday. In short no leave.

 

Comapny cut each day salary if not present.

 

I want to know is it legal to do so?

 

Under which law my company falls?

 

 

Howmany leave i.e. CL, PL & medical leave I would get as per law?

First of all determine the office/dept. where you are located is registered under which Act e.g. :

 

Gujarat Shops and commercial Establishments Act (Gujarat followed Bombay Shops and commercial Establishments Act)

Factory Act

 

and look for sections on leave in the applicable Act.

 

The number of leaves,entitlement of leave, rate of salary during leave, OT,compensatory off  etc is all explained in it and employer can't provide for less than it and of course it can provide superior benefits........................
