Legal action on written-off credit card debt of ~ 10 lacs

I have approx. 10 lacs written-off by the credit card issuer. It reflects in the credit reports from Experian, CRIF but not on CIBIL.

I get regular emails from card issuer reminding me that they "will be constrained to take legal action" if we cannot resolve the matter amicably.

1) What do they mean by "constrained to take legal action"?

2) Are they likely to file a civil or criminal suit?

3) What happens if I am ex-parte in the court proceedings?

The written off status is lender’s/CC company’s internal record to adjust books.

The usage limit in Card is huge/extra ordinary.

IT is usually civil action.

You may take help of elders of your family, competent and experienced well wishers, seasoned PIP’s, helpgroups, community leaders, NGO’s that help in such/CC matters, experienced colleagues, associations, etc and  find a very able LOCAL counsel/Law firm specializing in concerned filed of law e.g; Consumer/Civil matters as in your case, and well versed with LOCAL applicable rules, precedence, latest judgments etc …. and worth his/her salt, can advise you after examining all case related docs, inputs,  evidences on record.

One should not fall for IT’s and entities loitering at online portals to allure unsuspecting querists. There are many threads on such instances at LCI also.

Online discussions are not substitute to in person discussions with a very able counsel of unshakable repute and integrity specializing in concerned field of law… Consumer/Civil matters.

There are such very able counsels at each location.

Check at LOCAL; DCDRF, Civil Courts, HC, SC..

Discuss in person with your LOCAL counsel.

You can also try for FREE legal Aid from Legal aid center (DLSA) that is usually within LOCAL courts complex..preferably from a very able counsel specializing in Consumer/Civil matters.
