Legal heirship certificate - kerala

Hi,

My brother died last June. His legal heirs are mother, wife and 3 years old boy. For his bank claims (FD : 5 lakhs) , bank is asking for heirship certificate.

 

 

1) What is the procedure for getting legal heirship certificate in Kerala? What documents are required? We have only his death certificate.

 

 

2) Do I need to apply in near by village office, where he was residing at the time of death or any village office or in court?

 

 

3) Somewhere I read for claims above 5,000/- need to apply in civil court is mandatory. Is it right?

 

Please advise.

Normally, Legal Heir Certificate will be issued by the concerned Taluk Head Quarters Tahsildar, who is having Jurisdiction over the last residing place of the deceased, after getting reports from his subordinates like Village Officer and Revenue Officer. So, you can apply for Legal heir certificate to the Tahsildar along with  death certificate. 


If there is any money claim, Succession Certificate is necessary which can be obtained from the court only.

You have to produce documents, like death certificate and legal heir certificate obtained from Tahsildar,  to show  the date and place of death and legal successors of the deceased person along with other supporting documents if any.
