Dear Querist,

A Caretaker is at best a licensee - who was allowed to be on the property as a part of his duty to take care of the property. The license is automatically on his employment ceasing. If he fails to vacate - file a suit for recovery of possession.

Mr. Chugh,

Thank you for your response. Can a Mandatory Injunction petition under Section 39 in The Specific Relief Act, 1963 also  be filed to vacate the caretaker ? Please advise.
