Legal status of a dementia sufferer

 

Hi,

 

Is a dementia patient considered legally incompetent in regards to his/her property matters in India?? My father is suffering from this and the doctor says that its due to ageing and that he may not be able to recover from it. I have 5 more brothers who are coercing him to will his property into their favour or register it in their name but he is not in a position to make a decision. If they do manage to get it registered in their name will it be legally valid? Can you please suggest the best course of action. In the past my father had given me a GPA as he trusted me only. Can I make decisions on his behalf or is there some other better alternative. His treatment is on going but no improvement seen in past 2 years.

Note that only GPA will work and coercion as of now by your brothers which will be UNDUE INFLUENCE on a dementia patient who can recover through alternative medicines at Tibbia College in Karol Bagh in West Delhi.
