Limitation

How to calculate the limitation period to prefer an appeal

 

Here is a formula :

 


Eg:

 

1. Judgement day                    8/2/2010

                                    ________

 

   30 days ends on                  8/3/2010

   Feb. has got 28 days only, so   

   2 days added                     2 days

                                           ___________

   Last day of limitation         10/3/2010

   to file an appeal

  

   Application for certified copy

   given on:                      12/2/2010

 

   copy ready on                  1/3/2010

 

   from 12/2/10 to 1/3/10         17 days

 

   time taken for supply of certified copy

 

                              10/3/2010

                              17/3/2010

                             __________

Last date of Limitation       27/3/201  

 

2.  Judgement day                            8/2/10

 

    Application for certified given on      12/2/10

 

So there is delay of 4 days.

 

   Certified copies ready on                1/3/2010

 

   30 days – 4 days : 26 days remained to file an appeal

 

   1/3/2010( certified copy supplied) + 26 days= 27/3/10

 

Last day to file an appeal is 27/3/10.

it is also applicable to file any appeal to calculate the limitation period

for second appeal it is 90 days

i think the respected sirji (Advocate Rajeevji) has given execllent answer so that a layman can also understand thanks a million sirji god bless u living long & happy life. 

But the apbve limitation is applicable to all the appeal (whether 1 or 2) to all SLP & any writ also to the criminal appeal(S).
