Loss of goods in transit

Good Evening everybody,

I am looking after the legal department of our organisation. I have a query and concern related to the below mentioned issue, please find below the details in regards to my concern.

We have purchased a machinery from Abroad which was suppose to reach to our destination, but unfortunately the shipment had been lost in transit and we have placed so many reminders to the cargo service person in regards to the said issue and he acknowledged that the goods had been lost and it was due to their negligence

Furthermore, they have agreed to refund the entire amount but the complete communication they have done was verbal, but we have always gave them the reminder via-mail.

The issue is pending since 2 years but they havent cleared the due amount till date.

I also wanted to know at the time of shipment they had issued the receipt wherein it had been stated that, nobody can claim the amount more than 5 times the bill amount in case of loss of goods.

Kindly revert on the above said query at the earliest.
