Maintainance in divorce case

My husband deserted me 4 years ago. DVA case is going on. last year i left my job. now he has filed contested divorce. I stay with my brother and mother in rented accommodation and have no income, can i claim the rent. please guide about how to file maintenance affidavit. Thank you.

It may depend on the reasons of your resignation from your job and the amount of your remuneration. If it is proved that you resigned your job just to demand rent /maintenance from your husband then it will be difficult to prove your claim.

The spouse can file.

IT shall be better to consult your own very able LOCAL senior counsel of unshakable repute and integrity specializing in Family/civil matters and well versed with LOCAL applicable rules/laws and having successful track record…. and worth his/her salt…….to help you

Check for such counsel at LOCAL Family/civil courts, HC, SC.

If possible crease all differences and save the marriage

Or explore possibility of MCD and end the troubled wedlock on amicable terms. Your spouse may also agree.

In case of financial constraints seek free legal aid from DLSA.

The court shall decide the matter on facts, merits.
