Marriage dispute

Respected Lawyers,

My daughter got married at the end of 2013. Since the marriage the my son in law and their family is money minded. Even before the night of wedding around 11 pm they demanded and got 1.25 lac from me. With in a month they forced me to buy all materials for a home, costs around 2 lacs. Because of his mental torture, my daughter separated from him within 10 months.  After sometime we went the rented house to get her dresses, they vacated the home and take away all the materials we bought to a undisclosed location.

We filed a police complaint just for the recovery of the dowry amount.,  the house hold articles and some jewelary which my daughter left in hurry to leave the matrimonial home.  They dodge with some or other pretexts.

In the circumstances we filed a HM divorce case at our native place, u/s. 13(a).  The police complaint is also still there. Whether we get the cash and materials thro' police or else.

Kindly advice me.

File DV case if feasible

Dear, Yes you should push and get the things from police only .... File 406 and 498a as well along .... Kapil Chandna Adv 9899011450

Dont file any 498a, 406 and spoil the already spoilt life of your daughter.   You can get the articles back and also money back from magistrate court under DV act.

The police will be of little or no help to recover the cash and jewels from him on verbal modes.  It is better that you lodge a complaint for recovery of her articles including her gold jewels lying in his possession for which police will register a FIR u/s 406, which will make him to think about returning the same or to face the prison.  DV case may not be very effective on such issues;
