Maternity leave & pay

Dear All

One of our employee going on maternity leave her gross salary Rs.60,000/- pm (under shops & establishment act)

Please clarify the followings 

01.She is eligible for maternity leave ?

02.if eligible how many days leave she will get ??

03.how to pay the leave wages ( on Gross or on basic wages ) ???

04.wage limit up Rs.?????

There is no wage ceiling.  

If she has worked for a period of not less than 80 days in the 12 months immediately proceeding the date of her expected delivery, she is eligible.

                      

Maternity Benefit Period 12 weeks: 6 weeks prior to pregnancy delivery and 6 weeks after pregnancy delivery.       

The Maternity Benefit is paid in advance to the woman on production of proof that the woman is pregnant and the amount due for the subsequent period shall be paid to the woman within 48 hours of production of proof that the woman has been delivered of a child.

                                                                                                      

Rate:

@ 'the average daily wage'…………………the average of the woman's wages payable to her for the days on which she has worked during the period of 3 calendar months immediately preceding the date from which she absents herself on account of maternity.

 

She shall also be entitled to receive from her employer a medical bonus of Rs.3500/, if no pre-natal confinement and postnatal care is provided for by the employer free of charge. The medical bonus shall be paid along with the second installment of the maternity benefit.
