medical negligence

Nowadays hospital managements are increasing facing prhen giving problems regarding the facilities ,standard of proffesional competence and the appropriateness of their diagonostic and treatment method,as a result of which many patients are suffering and in some cases its leading to death.But somehow i feel the law regarding such medical negligence is not as strong as it should me.Rather then concentrating more onthe victims,its more focused towards the dignity ofthe proffesion and that of doctors.Is this the right thing being done?

In a case where due to medical negligence,a person dies. Than under what should the case be filed-LAW OF TORTS OR CRIMINAL LAW?
