Memorandum of withdrawal or court decree

Dear Sirs,

A civil suit was filed against me by Mr X in respect of alienation of property.

Now the plaintiff agrees to have the matter settled in lieu of financial compensation, and has offered

to withdraw the petition filed against me, on payment of the agreed sum.. Filing of memorandum of withdrawal has been assured.

I would like to know, please,

a]  whether I could settle for withdrawal of case, as an out-of-court settlement, OR

b]  to insist on a Court decree under Rule 23

To obtain a Court decree, should I contest the case file against me or just submit the Compromise Agreement

to the honourable Court.

Can you, Sirs, guide me on this?

You can go for an out of court settlement and file an an application under rule XXIII ,along with the requisite affidavit for  seeking the permission of the court ,to pass a decree to that effect.Thiswill put an end to the litigation initiated against you.
