Mobile service centre not responding

Sir I purchased a Micromax E313 mobile on 09.05.2016 through Flipkart. This mobile has 1 year manufacture warranty. This mobile has technical problem and I reported personally to Micromax Service Centre Hubli on 03.11.2016. After a week, the service centre person called me & told that you may collect your mobile as your complaint is resolved. After 10-15 days again the same technical problem exist on the mobile. Again I called the customer care and they told me that you may please handover the mobile phone to Micromax Service Centre Hubli. On 30.11.2016 I handed over the mobile to Micromax Service Centre Hubli to resolve the same technical issue from my mobile vide Complaint No: S010065-1116-26695829. Micromax Service Centre Hubli service executive told me that it takes 15 days time. I went on 19.12.2016 to collect my mobile again they requested for another week time. Again I visited on 28.12.2016, they told me that please come on Friday. Again I visited on 30.12.2016, they told me that please come after a week. So I am keep on calling over phone about the status of my mobile complaint raised on 30.11.2016. Once again I visited the Micromax Service Centre Hubli on 09.01.2017, 20.01.2017, 23.01.2017 and finally on 27.01.2017 Micromax Service Centre Hubli gave me one mobile which is lower than my Micromax E313 mobile. So comparing the technical specification with my mobile I said I don’t want this new mobile I need only my mobile i.e E313 or higher version mobile. The executives of Hubli service centre promised me that they provide E313 mobile or higher end mobile within a week. So I keep on calling them till today no reply received except giving dates like 01.02.2017, 03.02.2017, 04.02.2017, 06.02.2017, 07.02.2017. Today i.e on 08.02.2017 when I called the Micromax Service Centre Hubli again they said me “we are giving you new mobile i.e Q413” When I checked its configuration, I found again it’s a lower version then my E313 mobile. I said the executive sir on 27.01.2017 I rejected your offer with same comment now also I stand on my words. Apart from this I personally give one more suggestion, if you are unable to resolve my E313 technical problem then at least provide me Micromax Canvas 6. The difference price between these two mobile i.e. Rs 3300/- I ready to pay. Again the executive denied my proposal and asked me to provide another 15 days time to resolve my E313 problem. So, now my query is – 1) I want my money i.e Rs 6199/- back instead of mobile. 2) Now I want Micromax Canvas 6 mobile without paying any extra cost. Or I want compensation for harassing me from long time i.e. 30.11.2016 to till today.

You have remedy before District Consumer Forum,Hubli, wherein you can appraoch. Prior to all this you should as lawyer to send legal notice to Flipkart and Micromax. This may consume some time,but yes ,your grievances would be properly taken care off. You can do the entire work , self,engagement of lawyer is not mandate, you can very well plead your case before consumer forum. Thanks Vinay Sharma,Adv.9873751988
