Mother entitled or not?

An employee (who is Hindu as per job) took Christian faith, died intestate.  Whether his mother will get share along with wife or not, under Indian Succession Act?

I have 5 Brothers and 4 Sisters, our Father and mother expired on 2001 & 2005 respectively.  Father's Name 11 Cents land and the same is filed EP from Federal Bank. If it is paying the liabilities any one how can get back the money from the others is it possible or not

The only way. File Letters of Administration application. Everybody has a share. Who is paying to the bank is immaterial.

If he died as christian, his mother will not get the share. Indian succession Act is applicable.Only his wife and children are entitled to get the right on his property.

On conversion to another religion, which succession law applies?

Devajyoti Barman (Advocate)     30 December 2009

A person after his conversion to Christianity will be trated as Christian for all practical purposes and a Christian having died intestate his mother is not entitled to any share in the property in presence of his wife and children as per provisions of Part - V of Indian Succession Act.
