Muslim family: property issue

Hi All,

 

1. We belongs to islamic community

2. My father has 2 wifes.  

3. My father bought one house for his first wife and son and registered on his first wife name. It happened 20 years back.

4. My father haven't given any properties for us (second wife and her sons), however he has taken care of all our needs (food, health, cloths, studies) and after second marriage he is staying with his second wife only.

5. I got JOB six years back and with my salary money we builtd a house and we bought some land (everything is  with my salary money only) and the all properties (house and land) registered on both my mom and father. And all the properties are registered only after my job.

6. My fahter passed aways 2 years back.

7. Now we are getting symptoms from the first wife family that they have plans to file a case for seeking their portion in the property.

8. Honestly, spekaing neither my mom nor my fahter are the owners of this property. Even my own brothers (the other sons of second wife) havent contributed any thing for buying this properties. 

9. So at this stage, if the first wife family files a case, seeking their share in our property, is it valid?

From your question it is clear that  whatever properties are in your name are self acquired property.  First wife and her sons or daughters cannot claim any share in those properties.  If they files any case you have to contest the case.

You have got source of income so you have good defense.

Hello Rajiv,

 

As I mentioned at point no.5 the property registered on my father and my mother (second wifes) name. It is not registered on my name but it is bought with my money only.

 

1. Now my fahter is no more.

ok.  Whether your father and mother had got any indpenedent income?  If they had then it is problem, if not you prove it that you had contributed to purchase the property.l

My mother is house wife. My father was daiiy labor. They dont have independent income.
