mutual divorce

my wife did court marriage in her own hometown in guwahti after being in relation with me for four years ... now her parents have taken her in their own home ?? can she file for mutual divorce alone by misrepresenting me with other man as she has my id proof in original ???? how would i avoid me ?? as i dont want divorce.and want to save my marriage ...

What kind of wife you have?  How can your wife do court marriage with another person?  It must be so that either the marriage which she did with you is fake marriage or marriage which she did with the new guy is fake marriage. Either ways whether marriage is fake or not, person who did marriage is fake for sure, now who among you is fake is for you three to vote and check.

Now where did matter of divorce crop up?

First your marriage should be proved, then can you or her think of applying for divorce.

You seem to be baffled by the thought of marriage itself which has in turn consumed you to the extent of thinking what not and all.

If you both ran away and got married, trust me, that is not called marriage.

If she left you midway after spending few nights with you, then your hunnymoon is over.

She already ready for honeymoon no. 2 and you are having just hangover.

Approaching court will surely help in this matter if you have evidence of marriage no. 1 with you.  But its not worth it.  

 

People in India wait to get divorce for 10 years, you will wait to prove your marriage to her for 14 years if  you approach court.  See what worksout for you and move accordingly.

Dont drink.  It really takes away the perspective.

Sir, (1) You should have documentary evidence of your marriage. (2) It will be a criminal offense if someone impersonates you and a decree of divorce obtained by such impersonation is null and void. (3) You can not save your marriage without the consent of your wife. Good luck, Kishor Mehta

  • Both parties bride and bride groom  along with three witnesses are required to be present on the date of registration/Solemnization for court marriage. How can misrepresentation situation occurs. If so, you can send objections notice.
