mutual divorce process advice

Hi,

i had filed for divorce in march and my husband who is a nri was present at tht time and we filed a petition for mutual divorce.our counselling was done on the same day and the report was also sent to the concerned judge stating tht we cannot stay tgther.after tht my husband left india and our next date after 6 months was in september.now he was required to send a signed affidavit which was to b submitted in court in his absence.but neither he nor ny of his family members were present on the date.we have got a next dat of october and they are not yet willing to cooperate.

my Q's are:

1.can we get ex party in this case?

2.what is the duration after which we can b granted ex party?

3.we have not satyed tgther since 18 months.is there any other way to file for divorce by withdrawing the mutual petition?

any kind of help/advice will b hugely appreciated...

Ask an explanation to your lawyer also b'cos your lawyer failed to inform you about this eventuality.

 

Change the lawyer immediately.

 

Devise a new strategy.
