Mutual Divorced

I am separated with my husband from 2 yrs. I have file petition for divorce and it has been rejected. Now family convinced my husband for Divorced and we got signed in notari for the same. Now do I need to go for mutual Divorced to get decree? What if I go for mutual and my husband not agree at that time for divorce?

Yes go for mutual consent divorce by Convincing your husband for the same.if your husband doesn't appear during either the first or second motion then your mcd petition would be dismissed and you need to file a fresh petition for contested divorce

only notary would not be work

there is proper court procedure for MCD with 6 month period between first motion and second motion.

if any of the party turns in second motion that the other have to file fresh petition on the basis of new conditions or shoud go for contested divorce

As per law, duration/time of obtaining mutual consent divorce is six months.
