Ncdrc delay

Respected Members/Experts:

I had filed consumer case against a Builder in State Commission, West Bengal in March 2007 and the Ld. Commission had ruled in our favour in February 2009.

Builder filed appeal in NCDRC and after a long delay the matter was heard on March 12, 2014, but  the judgment has been kept in reserve since then.

In this connection, my queries are as under:

1.For how long can an Order be kept in reserve by NCDRC?

2.Will the delay prevent us from filing an appeal in the Supreme Court (if the final order of NCDRC be found unsatisfactory)?

You can move to supreme court as the delay was from ncdrc it is not your fault. For more call 09910657998 mahavir singh advocate.

Where is the question of delay?? Till today the Ncdrc has not given his judgement...after judgement u can immediately file prooceedings before sc. If judgement is not in your favor...

Period of limitation will start  from the date on which you receive copy of judgment from National Commission so don't worry.Delay means after pronouncement judgment,aggrieved party does not file  appeal or application within prescribed period.In your case judgment has not been pronounced yet so no question of delay.

Thank you for your reply. However, the following points are still unclear:

1.For how long can NCDRC officially withhold an order?

2.After hearing of arguments why is an Order generally withheld?
