Dear All,
Need citation on topic,
After preliminary decree, One of the decree holder 3rd plaintiff died, But before the death of decree holder her son had predeceased her ,as per Mohameddan law predeceased sons legal heirs are not entitle for any share in their grandmother property but somehow they were brought on record wrongly along with other legal heirs of 3rd plaintiff while filing final decree petition,hence we want to strike out wrongly brought LR's on record in the pending final decree proceedings.
Hence in need of citation where in Order 1 rule 10(2) used in pending Final decree proceedings to strike out co-LR's of a plaintiff not entitle for share in a partition suit..
