Need help on getting divorce

Dear All most experienced members and advocates

I am dead lock in situation where i am not able to get ways out of it.

I am separated from x-partner in Jan-2013. 

In Jan-2014 one year is about to complete. There is no legal process till now in our case.

Got married to her in Feb-2009 , no child.

I am right now in canada ( permanent resident of canada) since 4 months,before that i was in india.

When i was in india i tried for mutual concern but it did not worked out .

She is 8 years younger than me and she want to waist time.

Please advice me what steps i should take to get out of this dead lock condition with safe and i can start my new life.

Hi,

Is she willing to give mutual consent??? if not then you need to create grounds on which you can contest the divorce petition in the court of law... you have also not mentioned your location in india..

Mak,

You have a chance to dissolve your marriage by a decree of divorce on the grounds of mutual consent provided she accedes to this by signing the papers and if she doesnt, you may file a divorce petition on the grounds o cruelty, non-cohabitation and desertion but the case will drag on for years, for which your presence in India is essential.  Consult a lawyer of your locality and proceed on his advise or issue a legal notice to her to join you at Canada, if she refuses,  consult a lawyer at Canada and process the divorce papers from there itself.

Adv Simi Salooja ; Gujarat was my location.

As i mentioned that i tried for MCD but it did not worked out. They want to waist my time. I can not offer her to come to canada becouse i do not want her to be in canada. 

Is it possible to file divorce case in canada ? If yes then do indian court will validate it ? Does she challange it later on in India ?

Please show my right way .
