Need serious help : widow getting harrsed by relatives

 

Hi,

This posting is for helping one of widow at my native.  Please, I wish to suggest her some

help, to live with dignity and survive...

 

Scenario :-

 

1. Widow : her husband expired 6+ years back.

2. She was survived by 1 & 3 years old sons.

3. Her family, was joint family till husband was there.

4. Husband has 2 brothers, husbands sister is not married (40+ ) age and stays with mother, brothers...

5. Now, They have 4-5 acres of agri land.

6. Post that family evacuated widow and got hold of bank details, property and  cattles.

7. She got just one small piece of land and hut like house to stay. without any money..
but she does lot of hardwork.  From that position, she started working hard and earning for kids.

8. Slowly, she started saving money and got not so good..but better house repair from that hut kind.


9. Now, her B-I-L-s, S-I-L  started giving trouble to her .. like stopping water to her farms from joint well..

10. There was drumstick trees in common...  that was common to all these family..

B-I-L cut down those trees ... even when it was giving income to them as well as this Widow.

11. Now, day by day..they fight and harras her..  they just take  advantage of her situation..

 

12 She is not taking any penny from anyone..she works very hard to live piecefully and respectfully.

13. is there anything she can do..so that those guys will not toruture her and harrass her. 

She is earning her bread and butter on her own... and not depent on any one...

Police doesn't register case...as its native place and B-I-L..SiL manage them ... so its very diffcult..

Please, guide me..what I can suggest her ... and what at various ways Indian govt protects these kind of weaker sections of society...

1.  She has to engage a good advocate.

2.  She has to file a domestic violence case against the relatives of the husband, who have been troubling her.

3.  She will take protection orders against their intervention into her property and peaceful life.

4.  She will also take restraining orders against them not to enter the premises where she and her children are residing.

5.  If she felt she could not get legitimate share of her husband out of the joint family property, for that also she can file claim suit.

6.  for filing domestic violence case or partition suit, she does not require police help nor she require to go to police station.  Only a good and kind advocate will assist this hapless lady.
